I get them on weekends (court ordered) but I’m usually drunk when I go to their house. She won’t let them drive with me but isn’t that illegal? If it’s a COURT ORDERED joint custody, I have a right to take them, drunk or not. And don’t give me the whole thing about driving drunk is illegal too. It’s 2010 for chrissakes. People drive drunk now. Get over it. I usually let one of them drive half way home anyway (the oldest is 7). It’s a little travelled country road and we switch places in the city.

“The rumor about alcohol being involved by either party, especially the truck driver, is incorrect,” said Jerome O. Herlihy, a Delaware Superior Court judge who was chief deputy attorney general and worked with crash investigators in 1972.
“If it were some part of a cause of the accident, there would have been a charge, simply because if you’re driving under the influence and kill someone in the process — whether it’s the wife of a U.S. senator or anybody else — there’s going to be a charge,” he said.
And look at lovely ol’ Biden’s camp had to say when Dunn’s daughter became distraught over her deceased father being maligned:
To see it coming from [Biden's] mouth, I just burst into tears,” Dunn’s daughter, Glasgow resident Pamela Hamill, 44, said Wednesday. “My dad was always there for us. Now we feel like we should be there for him because he’s not here to defend himself.”
Biden spokesman David Wade said Wednesday that the senator “fully accepts the Dunn family’s word that these rumors were false.”

DENVER – Courtroom spectators in attendance for unrelated cases were brought to tears as Barbara Barben’s family described the devastating loss caused by the driver who was so drunk he was nearly comatose behind the wheel.
Alberto Alvarado-Barojas, who is in the United States illegally, was sentenced to the maximum of 12 years in prison after pleading guilty to vehicular homicide. He is expected to be deported to Mexico upon his release.
Alvarado-Barojas had a blood alcohol level of at least .393, about five times the legal limit, when he ran a red light on Hampden Avenue and hit Barben on the morning of September 14, 2009.
Paul A. Barben, Barbara Barben’s widower, said there would be no forgiveness.
“My grandchildren have had their grandmother taken from them. My sons had their mother taken from them,” Barben said. “And I lost my best friend.”
“The vision that I go through daily is knowing that my wife’s last moments on Earth were spent in anguish and in the indignity of being ground into the gutter by Mr. Barojas,” Barben said.
Christopher Barben, the victim’s son, called Alvarado-Barojas “an uninvited guest in my country” who “seems to have a flagrant disregard for the law.”
Another one of Barbara Barben’s sons told the judge that Alvarado-Barojas is a “thief.”
“He stole the soul of my family,” Paul Barben said. “He also stole a plethora of memories not yet made, memories that will never be made.”
Barojas, through his attorney, asked for a sentence of probation and spoke briefly through an interpreter.
“This was an accident,” Alvarado-Barojas said, directing his comments at the Barben family. “I ask for your pardon.”
Judge Shelley Gilman said Alvarado-Barojas was not taking responsibility for his actions. She noted that he had the highest blood alcohol level she’d seen in her 12 years on the bench.
A 9Wants To Know investigation reveals a warrant for Alvarado-Barojas’ arrest on a previous DUI charge was prematurely dismissed, eliminating an opportunity for authorities to arrest and potentially deport him a year before the crash that killed Barben.
The 18th Judicial District, Colorado’s largest by population, including Arapahoe, Douglas, Elbert and Lincoln Counties, accidentally purged hundreds of unresolved misdemeanor cases years before they were due to be reviewed for dismissal.
In each case, a suspect had a warrant for failure to appear in court.
Alvarado-Barojas’ original case was dismissed and his warrant cancelled along with 1,109 similar cases in 2007.
9Wants To Know has determined one in four of those cases, 285 cases including Alvarado-Barojas’, were not eligible for dismissal under rules established by the 18th Judicial District and District Attorney Carol Chambers.
Denver Police recorded contact with Alvarado-Barojas in 2008. DPD spokesman Sonny Jackson said no information exists as to the nature of the contact, only that Alvarado-Barojas’ name did not bring up any active warrants and he was not cited or charged with a crime.

My dad got killed by a drunk driver.
The drunk driver also died.
The other car was owned & insured by the drunk driver’s wife.
The drunk driver’s was driving without a license—had a previous drunk driving conviction that revoked license.
The drunk driver’s wife is charged with willingly letting him operate a vehicle while impaired.
My dad’s insurance:

Assume the drunk driver’s estate has zero value.
Which parts of each policy can I make claim against?
If a court rules for a settlement larger than the insurance policy limits, and the drunk driver’s estate has zero value, will the insurance pay any of the amounts over the policy limits?

A drunk is driving through the city and his car is weaving violently all over the road. A cop pulls him over and asks, “Where have you been?”
“I’ve been to the pub,” slurs the drunk.
“Well,” says the cop, “it looks like you’ve had quite a few.”
“I did alright,” the drunk says with a smile.
“Did you know,” says the cop, standing straight and folding his arms, “that a few intersections back, your wife fell out of your car?”
“Oh, thank heavens,” sighs the drunk. “For a minute there, I thought I’d gone deaf.”
cars when I was backing out of the driveway? I know its my fault and I shouldn’t drink & drive but they both had their rear ends sticking out way too far.
Jeez, such harsh reactions, I was only moving the car out of someones way, not driving somewhere, her friends, Jim & Kevin know that I hit the cars and I am paying for the damages, but my wife tends to overeact to petty things
Everybody does it right? A few beers, You dont think your ability to drive will be hindered…I am representing a husband whose whole family, 4 little girls and his pregnant wife…killed by someone who just had a couple of beers….Do you drink and drive?
the drunk driver says only had two beers very quickly on way home after work, bartender only served 2 beers, tested just over legal limit…went over center line, drivers behind him said he had been weaving…no cell phone involved
Yes I am an attorney, and yes I have drank a couple of drinks at a lunch, or at a dinner and driven home..thinking 1 or 2 drinks, I can drive ok…what lesson is that for my kids…I can say I will never do it again, nor will my husband, never….
A male driver is pulled over by a cop and the following conversation takes place:
Man: What’s the problem officer?
Cop: You were going at least 75 in a 55 zone.
Man: No sir, I was going 65.
Wife: Oh Harry. You were going 80.

Cop: I’m also going to give you a ticket for your broken tail light.

Wife: No, only when he’s drunk.
Ok, I’m currently married but may be seperating from my wife. She doen’t want me to go out and drink and drive home because she says that SHE would have to pay the fine,not me, and HER insurance would go up, not mine.The car in question has both our names on the loan and both on the title ( not sure how it’s written on the title) So,,,,I think this is a bunch of crap. If i get caught with a DUI, I go to jail,loose my privilage to drive, and have to pay the fines. Just because her name is on the loan and title of the car in question, whould she be affected by this at all? Thanks for your help!!
KENOHA –Frank Glogovsky teared up as he described the night that changed his family’s life forever.
He was driving home on Memorial Day with his wife, Dawn and their son, when a car slammed into them.
He says he did not see the other driver, only a shadow, because he was attending to his injured wife.
Prosecutors say that driver was Jorge Dominguez. Dominguez is an illegal immigrant with a criminal record. According to a criminal complaint, he told investigators he’d had 8 drinks on the day of the crash and had taken cocaine recently.
Glogovsky’s testimony was part of a preliminary hearing to determine if enough evidence exists to send Dominguez to trial. Prosecutors have more witnesses to call so the hearing will be continued later this month.
“We were thrown into the ditch all the way on the other side and probably 20-30 feet into the ditch,” he told a judge. The crash killed Dawn and injured Frank and their son.

Your opinion illegal driving drunk & has criminal record family’s life is forever changed do our families count in this debate ?
Long story short, my wife went out of town (business) so me an a few of my friends got shitfaced at the house. We ran out of beer around 3am so we played rock,paper, scissors…I lost so i drive to the liquor store and get another 24 pack and head home. I think i see a hot chick (which later turned out not to be) on the side of the road, distracted looking at her i go to pull in the driveway (still looking in my rear view mirror at what i thought was a hot chick) an BAM!! i hit the house with the car. I kinda think “put it in reverse an get the hell out of here” for a minute…then i realize its my house…My buddy’s come out an we decide to tape the side of the house up with 3 rolls of duct tape and paint the tape white to match the house. My wife will be home in 3 hours an i cant think of any good lies…..Any ideas?
I was thinking about telling her the car was stolen, then returned by a drunk who hit the house pulling in the driveway.
CHARLOTTE, N.C. – A judge in Mecklenburg County raised the bond Thursday on a man charged with driving drunk and felony death by vehicle after he posted bond six years ago and never appeared in court.
Police in Charlotte arrested and charged Jovany Morales with driving while impaired and felony death by vehicle in 2004. Frank ‘Buddy’ Cline III was driving to work in Charlotte on Feb. 22, 2004 when police say Morales was drunk and drove across center, hitting and killing Cline III.
Morales, who Immigration Customs Enforcement officials say is an illegal immigrant, posted bond in 2004 but never appeared in court. Authorities hadn’t seen Morales until last week, when Charlotte-Mecklenburg County police arrested him on assault charges.
Morales appeared in Mecklenburg County court Thursday to face his 2004 charges and his bond was raised from $18,000 to $200,000.
Angela Cline, Frank Cline’s wife, appeared in court Thursday to face Morales for the first time since the accident happened.
“I would love to have five minutes with him, just to ask him how he felt about it.” Cline said.
The district attorney told the judge that Morales was a flight risk, that ICE officials had a hold on Morales and that if Morales posted bond, he would be deported. Cline said she had asked the judge to raise Morales’ bond so that she had a better chance of seeing justice for her husband’s death.
“I just told him we have waited for six years, that I had to raise my kids without a father now and that my little girl was never able to lay eyes on her father and just asked that him not to put us in a situation to have to wait six more years and take the chance of him bonding out and fleeing again.” Cline said.

He got picked up dor DWI a couple of months ago when I was in Florida visiting my girlfriend, who’s father had just past away in February. My BF was out until 2:30am and got picked up by a cop for DWI. We were having alot of trust issues before this happened. I broke up w/him April 2. He kept trying to get back w/me, calling every day, showing up at my house, telling me how much he still loves me. I told him I can’t trust him for some of the crap he pulled on me. One Friday night he had to go 20 miles away to his son’s basketball banquet. After the banquet, the coach had a party, by BF went,drank too much to drive home, his x wife was at this party too. So he was going to come home but decided to spend the night at her house on the sofa. I know all this cause I decided to call him around 11:00pm, and asked if he was home, I was coming over. 1st he said he was home, then said no he wasn’t, he was at a party. Is this a way to earn my trust back??
Hello, I’ve looked and looked and can’t find any information on the ramifications of having kids in the car while getting a DWI in Texas.
I recently learned that my EX-wife was caught driving drunk with my kids in the car. My Ex-wife and I don’t have the best of relationships, shes always trying to find ways to hold the children from me so I can’t visit them. The latest reason they can’t come over and visit is because my oldest son (10) has been doing bad in school and not doing his home work. She told him that he wouldn’t be able to come over to my house until he gets better grades in school and does his home work..
The last time she with held the kids I owned her a few months back child support. The time before that she didn’t like my new girl friend. The time before that I was living alone and she didn’t like me having a babysitter for them,, and the list going on.. I’m feeling like my kids are a pawn in the little games she likes to play.
The recent DWI scares me,, I learned through a friend that she got the Felony DWI with my kids in the car, she was with her boy friend and he also has been convected of multiple DUIs and doesn’t have a drivers license.
Why wasn’t I informed about this, I don’t even know how my kids were turned home or with who. My ex-wifes boyfriend does not have any custody rights to my children. I’m in awe that this has happened and I can’t find any answers to my questions.
I’ve been thinking about taking her back to court for not letting me see the kids but it’s so expensive I just can’t afford it… So she keeps getting away with it and holds it over my and my kids head that she can refuse me to see the kids when I know she can’t.
Does anyone have any answers that relate to my situation??

I already tried CPS when I found out they were both using METH,, CPS went to their house and didn’t do anything,, In fact they came back on me and we were all drug tested for six months,, They cleaned up their act once that happened, and once again when she found out I called CPS she refused me to see the kids again!
I have to think this though clearly. I don’t want any other problems with her. I’d rather just show up in court some how and tell the story.
I’m sure my oldest son could talk for himself,, he’s (10) and my youngest is (7). They both say they’d rather live with me..
