Kmart sold a rifle to William, who was a heavy drug user and was under indictment for a felony. Federal law prohibits the sale of firearms to such persons. Kmart was supposed to question potential customers about drug use or felony indictments but failed to do so. William’s brother, a heroin addict, took the rifle while using drugs and attacked his wife and a police officer. Can the police officer sue Kmart? For what and why?

    Yes, anyone can sue anyone else. Even though they’re idiots, they can still sue.

    Seriously, how do people read these kinds of things and think KMart owes the cop money? Everybody’s a victim.

    You need to find your own answer. They key is in your first sentence. ‘…under indictment’.

    As you well know one can sue anyone for just about anything.

    With the assumed statement that K-Mart failed to question then they can be sued.

    Burden of proof is on the one suing.
